The assisted reproduction legislation was approved   for all assisted reproduction techniques also to solve infertility problems and the need to address a regulation to  oversee patients who undergo this kind of treatment.

What does Spanish assisted reproduction law claim on the egg and sperm donation?

Sperm and egg donation are procedures regulated by Spanish law since 1988. The purpose is guaranteeing ethics and professionalism of medical and biological processes involved with these techniques as well as the health condition of donors and of the embryo produced by donation.

Some aspects which are included in this law are the following:

  • Oocytes’ donors must be in the age group of 18 to 35 years.
  • Sperm’s donors must be in the age group of 18 to 50 years.
  • Egg and sperm donation is performed voluntarily, anonymously and altruistic manner.

Altruistic: eggs, sperm and embryos commercialization is forbidden according to Spanish Law. The egg and sperm samples must be exclusively used to help women with fertility problems in having a child. Nevertheless, even if donation cannot be a profit-driven or commercial character, the National Committee of Assisted Reproductionrecommends thatdonors can receive an economic compensation for all the trouble they went through and the time spent.

Voluntarily: The Egg Donation is an act that should be carried out as a personal idea and with full capacity to act, that means donors must be totally aware of the act they are going to perform and its consequences.

Anonymous: Law specifies that the process must be based on a complete anonymity between the donor and the patient.  This implies that data confidentiality related to the donor’s identity is guaranteed and the recipient woman cannot choose her gametes’ donor.
